Terms and Conditions for WorkTogether

These terms and conditions outline the rules and regulations for the use of WAM WORKS LTD's (“WAM”) Software as a Service app, called WorkTogether.

1. Acceptance of Terms

By accessing this app, and by using any of the software or apps developed by “WAM”, you are agreeing to these terms and conditions (“Terms’). Do not continue to use WorkTogether if you do not agree to take all of the terms and conditions stated on this page.

 

We may update these Terms of Service at any time. If we make significant changes, we will refresh the date at the top of this page.

2. Definitions

"Service" refers to the application, software, products, and services provided by WAM.

"User" or "You" means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service.

"Company" (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to WAM WORKS LTD, 71-75 Shelton Street, Covent Garden, WC2H 9JQ.

3. Service Description

The Service is provided by WAM and allows users to access and use an application to create and manage teams and vote on which days they intend to go to the office.

 

4. User Responsibilities

4.1. You agree to use the Service in compliance with all applicable laws and regulations.

4.2. You must provide accurate and complete information when creating an account and keep your account information updated.

4.3. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

 

4. Fees and Payment

4.1. Access to certain features of the Service may require payment of fees. You agree to pay all applicable fees as described in the subscription plan.

4.2. All payments are due in advance on a monthly or annual basis as specified in the subscription plan.

4.3. All fees are non-refundable.


 

5. User Accounts

You are responsible for maintaining the confidentiality of your email accounts and devices and for restricting access to your devices, and you agree to accept responsibility for all activities that occur under your account or device.

6. Licensing and Intellectual Property

All intellectual property rights in the Service and its content, features, and functionality are and will remain the exclusive property of WAM and its licensors. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Service for your internal business purposes.

 

7. Data Protection

7.1. WAM complies with the UK Data Protection Act 2018 and the General Data Protection Regulation (GDPR).

7.2. The Company is committed to protecting your privacy and data. All personal information and user data will be treated in accordance with our Privacy Policy and applicable UK and EU laws.

7.3. You agree that WAM may process your data as described in our Privacy Policy and for no other purpose. We use third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Services. You can see a list of all subprocessors who handle personal data for WAM in the privacy policy.

 

8. Confidentiality

8.1. Both parties agree to keep confidential any proprietary information disclosed during the term of this Agreement.

8.2. Confidential information does not include information that is publicly known or independently developed.

 

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

 

10. Limitation of Liability

10.1. To the maximum extent permitted by law, WAM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

a. Your use of or inability to use the Service;

b. Any unauthorised access to or use of our servers and/or any personal information stored therein;

c. any actions of any third party that uses the Services, or any other consequences related to the Terms or Services.

d. Any interruption or cessation of transmission to or from the Service.

 

11. Prohibited uses

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

 

  • In any way that violates any applicable national or international law or regulation.

  • For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.

  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "spam” or “phishing” messages and emails.

  • To violate another person’s privacy

  • To bully, harass, intimidate or otherwise harm any other person.


 

12. Termination

12.1. We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, if you breach these Terms.

12.2. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

 

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

 

14. Changes to Terms

We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after the changes become effective constitutes your acceptance of the new Terms.

 

15. Miscellaneous

15.1. This Agreement constitutes the entire agreement between the parties regarding the use of the Service.

15.2. If any provision of this Agreement is found to be unenforceable, the remaining provisions will remain in full force and effect.
